So I’ve handled tree fall cases before, this is a little bit different because this is a tree that it sounds like was on, the property of a, park, so it would be municipal property. The cases that I’ve handled were trees that fell from one person’s yard onto somebody else’s home.
And then what’s the question there? Did they have notice that their tree was going to fall at some point? And then they were negligent because they were told your tree is going to fall. You didn’t do anything. The tree did fall and damaged somebody’s home to the tune of tens of thousands of dollars.
So, the cases that I’ve handled are a little bit different because, they were a claim against an insurance company for the negligence of a home owner for not maintaining their property or their trees. If there’s personal injuries involved in that separate, then you need to talk to an attorney probably and investigate and see if there’s any insurance company or entity or person that’s responsible for maintaining the property, the tree, the soil, you know, things like that. Boy, that’s a huge tree though, right? That thing must be hundreds of years old. It’s just crazy accidents.
