  • Varicella Vaccine – Varivax Chickenpox Virus Vaccine, ProQuad
  • Rotavirus Vaccine – Rota Teq
  • Pneumococcal Conjugate Vaccines – Prevnar
  • Hepatitis A Vaccines – Havrix, VAQTA, Twinrix
  • Meningococcal Vaccines – Meningococcal Polysaccharide Vaccine (MPSV4), Meningococcal Conjugate Vaccine (MCV4), Menactra
  • Human Papillomavirus (HPV) Vaccines – Gardasil, Cervarix

What is the National Injury Compensation Program (NVICP)?

The NVICP was created in 1986 when several lawsuits against vaccine manufacturers threatened to cause a vaccine shortage. To prevent this from happening, the Federal Trust Fund paid billions of dollars to people who had negative side effects from vaccines. This is ongoing and people that experience adverse effects from vaccinations can still be compensated.

How Does the NVICP Work?

If you experienced a severe reaction from vaccination, the United States Court of Federal Claims in Washington, D.C. will need to decide if you are eligible for compensation. Here are the steps you must take to be considered.

  1. File a lawsuit in the United States Court of Federal Claims against the Secretary of the Department of Health and Human Services.
  2. The Department of Justice attorneys and the Department of Health & Human Services physicians will decide whether you are eligible for compensation.
  3. If the government agencies decide you are not eligible, the case will be further reviewed by the Court of Federal Claims to determine the final decision.

Who Can File a Claim?

  • Some people who have received vaccines outside of the United States I be eligible for compensation

  • The effects of the vaccination must last for more than six months after the vaccine is given or
  • The vaccination results in a hospital stay or surgery
