Fireworks & Car Accidents: Who Pays for the Damage?


 Section right now, shooting Roman candles outside the passenger window. This is why I live in Wisconsin. I have not seen any of these videos, from Wisconsin drivers. Let’s just take some pride that we’re safer than other states. That’s my guess. If you’re visiting Florida and you have people doing donuts, throwing or shooting fireworks out from the car.

Good luck, because that just sounds like it’s an accident waiting to happen and injuries waiting to happen. I don’t even know which insurance would cover that. I assume your auto insurance is gonna cover it, but it’s an intentional act. It’s derived from the fireworks derived from the car, so maybe the car insurance would cover it if a firework from the car flies and either hits you or sets something else on fire.

Maybe that’s the argument. We have some case law on this that we worked on a case somewhat similar. Not at all similar, but some of the facts are somewhat similar. And we got the car accident or the car insurance to cover a subsequent accident that wasn’t not in a car. But boy, this is unbelievable.

My mind goes right to who’s gonna be responsible and who’s gonna pay which insurance. I am at a loss, but if you’re in Florida, good luck finding an attorney who’s, really good and is able to help you if you’re injured because of this donut driving firework, wielding person. Good luck with that one.
