Car Crash Fault in Bus or Turn Lane – Who’s Really Responsible?


Transcript: Who is at fault in this crash between the red car and the white car? I’m gonna go out on a limb here and say something you might not agree with if that white car is in a turn only lane or a bus lane and there’s packed traffic ahead of it, and that driver chooses to go in a right turn only lane. I would say that driver is a hundred percent responsible because they’re in a lane.

They should not be driving in this case really super fast. What else is the red driver supposed to do? The other vehicles are stopped. The driver expects, the red car expects that the lane that’s meant only for right turns or buses is going to be used for only right turns and buses, and somebody’s not gonna be speeding that fast.

You assume that people are gonna abide by the rules and you have that right to assume that other people, other drivers are gonna abide by the rules. So I would vote that the white car is responsible if those were the facts. That’s my guess. What do you think about this liability split between the red car and the white car?

And we, we have a lot of examples here in Milwaukee where. You have BRT lanes, you know, bus rapid transit or bus lanes, right? Turn only lanes or bike lanes. And if, cars are not paying attention to those rules, that car is responsible. I’m just telling you, that’s my guess, that’s my opinion on this matter.
