Alright, we have your answer here from the legal trivia. The question was, if you slip on black ice outside of business, what matters most legally? Again, the time of day, the weather forecast, whether the hazard was addressed or what shoes you wore. In my opinion, I think I wanna know really.

Whether the hazard was addressed.

Is this something that was sitting there? Was this a hazard for days, for hours, for minutes? How long had this hazard been there? Because I think it’s important to know. Whether they acted reasonably. Going back to the reasonable person standard that we talked to, a number of days ago, did they act reasonable in a reasonable fashion given the circumstances?

Well, if you have ice on your, front walk and you know that the Amazon delivery person or UPS or FedEx are gonna be coming and delivering things, and you let that ice sit there and linger and linger and. It sits there for days, if not a week. Well, that’s not reasonable. So did you address this hazard?

If you don’t address the hazard, then you’re negligent.

That’s why I would say, one of the first things I’m gonna ask about is whether this particular issue was addressed.
