Autumn, that means more deer collisions. Well, how could this end up in court? Great question. You can’t sue Bambi. You can’t sue a buck or a doe. But if you’re a passenger in a vehicle and the driver isn’t paying attention and there’s a deer just sitting there in the road, and that driver. Hits that deer or veers off the road and is driving negligently, the passengers would have a claim against that driver.
Now it’s very fact specific. We see this a lot in the fall where people call us and they, wanna talk about the potential case against the driver or somebody else. The problem is you can’t sue a deer. So, it’s a situation that you really need to understand what took place. Was the driver irresponsible in how they were driving, did they properly operate their vehicle so as to, do everything they could to avoid that deer. Or were they texting while driving and then hit the deer, which caused you to be injured. That’s a claim. But if you’re driving responsibly and hit a deer, that’s probably not a claim anyway. If you have a question about whether you have a valid claim because of a crash that involves a deer, give us a call.
We’ll be happy to talk you through it.
