Rideshare Accident Insurance: Whose Coverage Applies?


We know that these kind of cases can get complicated really fast. What is the answer to this question? If a ride share driver crashes in icy conditions, whose insurance applies?

The driver, the passenger, the ride share company, or it depends on whether the app was active. I think the hint was, it’s really complicated.

In my opinion, it’s all of the above. A, B, C, and D. Because it certainly depends. So maybe it really is D it depends. But, I think it’s more than that. If the driver crashes and they rear end somebody else because they’re following too close. Then it’s the driver’s insurance that’s gonna apply for the, for the passenger, the other people in the other car, you know, things like that.

If the driver’s insurance isn’t enough, then the passenger, the passenger’s insurance, which is called underinsured motorist coverage might apply. So you have that. If the driver was on the clock at the time, then the rideshare company’s insurance is going to apply. And potentially, if that’s not enough, the passenger’s insurance, the underinsured motorist coverage, that could apply.

So really. D is accurate also because it depends on whether the app was active, was the driver on the clock or not on the clock. That’s something we see all the time. Did they turn on their app, turn off the app? Were they doing a cash deal? You know, those kind of things are really important. If they were not on the app, but they were still trans, transferring somebody.

They’re transporting somebody. Then what you have is a question of fact as to whose insurance, their personal insurance or not. Was there an exclusion on their personal insurance? You can see how complicated this can get pretty quick. The important thing is that you need to make sure if you’re a passenger in a ride share vehicle, that you have your own uninsured and underinsured motorist coverage, so you can just.

Rest easy. Sit back in the passenger seat and relax, knowing if a crash occurs, you are at least covered because you have your own insurance. If other people are not responsible, so what’s the answer? I think it’s all the above.
